Part 1: General Terms
These Terms and Conditions constitute a legally binding agreement between you ("User", "Guest", or "Host") and Jula for hotels and real estate local booking W.L.L. ("Jula", "we", "us", or "our").
Platform Nature: Jula is explicitly an online marketplace and marketing platform. We do not own, control, offer, or manage any Listings, Stays, or Experiences. Jula is not a party to the contracts entered into directly between Hosts and Guests. We act solely as a facilitator for the marketing and booking of these services.
You must register an account to access certain features. You represent that you are at least 18 years old and have the legal capacity to enter into binding contracts.
Identity Verification: User verification on the Internet is difficult and we do not assume any responsibility for the confirmation of any Member's identity. However, for transparency and fraud prevention purposes, we may, but have no obligation to (i) ask Members to provide a form of government identification or other information or undertake additional checks designed to help verify the identities or backgrounds of Members, and (ii) screen Members against third party databases.
You are responsible for maintaining the confidentiality of your credentials. You are liable for all activities conducted through your account. Jula assumes no liability for any loss or damage arising from your failure to safeguard your account.
Users agree not to:
- Use the Platform for any purpose inconsistent with these Terms or applicable laws.
- Copy, scrape, or aggregate content from the Platform without written permission.
- Book any Host Service if you do not strictly intend to use it yourself or for a group you represent.
- Discriminate against or harass anyone on the basis of race, national origin, religion, gender, gender identity, physical or mental disability, medical condition, marital status, age, or sexual orientation.
License Grant: By posting content (including photos, descriptions, and reviews) on Jula, you grant us a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to access, use, store, copy, modify, prepare derivative works of, and display that content in connection with the Platform.
Reviews: Reviews must be accurate, honest, and reflect a genuine experience. You may not post reviews that are coerced, incentivized, or contain defamatory, offensive, or discriminatory language.
Right to Remove: Jula reserves the right to remove any content, including reviews, that violates these Terms or our community standards, or that is irrelevant to the Host's services.
Acceptable Use: The messaging feature is provided to facilitate Bookings. You agree not to use it to send spam, harass other Members, or solicit off-platform payments/bookings.
Monitoring and Privacy: You possess no expectation of privacy regarding messages sent through the Jula Platform. Jula employs automated systems and human review to scan, analyze, and moderate messages for fraud prevention, risk assessment, and enforcement of these Terms.
No Off-Platform Payments: You may not ask or agree to pay outside of the Jula Platform. Doing so removes all Jula protections and may lead to immediate account suspension or termination.
Search Algorithms: The ranking of Listings in search results on the Jula Platform depends on a variety of factors, including strict search parameters (e.g., price, date, number of guests), Listing characteristics (e.g., price, reviews, amenities, Host history), and Guest preferences.
No Guarantee: We do not guarantee any specific placement for any Listing in search results. Jula may optimize search results to improve the user experience and the overall efficiency of the marketplace.
Jula Ownership: The Platform, including all associated intellectual property rights (software, trademarks, logos, and proprietary content), is the exclusive property of Jula and its licensors.
Copyright Reports: Jula respects the intellectual property rights of others. If you believe your work has been infringed on the Platform, please contact us with relevant details so we can investigate.
Right to Terminate: Jula may terminate this agreement or suspend your access to the Platform at any time, with or without notice, if we believe you have violated these Terms, applicable laws, or if your actions may harm the Jula community or platform security.
Appeal: If your account has been suspended, you may contact our support team to appeal the decision.
Part 2: Terms for Guests
Contract: When you book a Listing, you are agreeing to pay all charges for your booking including the Listing Price, applicable Service Fees, and Taxes. A contract is formed directly between you and the Host.
Payment Authorization: You authorize Jula (or our payment processor) to charge your payment method for the total amount. Jula collects these payments on behalf of the Host.
Booking Modifications: Guests are responsible for any booking modifications they agree to on the Jula Platform or direct with the Host (such as extending the stay or changing the dates), and agree to pay any additional amounts associated with such modifications.
Your ability to cancel a booking and receive a refund depends on the specific cancellation policy selected by the Host for that Listing. Review the policy carefully before booking. In the event of a cancellation by the Host, Jula will assist in providing a refund or rebooking, subject to our Refund Policy.
House Rules and Conduct: By booking a Stay, you agree to abide by the House Rules defined by the Host in the Listing (including but not limited to check-in/check-out times, maximum occupancy, pet policies, and noise restrictions). You agree to treat the Accommodation and the Host with respect. Failure to comply with House Rules may result in immediate cancellation of your booking without refund and/or removal from the platform.
Overstays: You agree to leave the Accommodation no later than the checkout time assigned by the Host or mutually agreed upon. If you stay past the agreed checkout time without the Host's consent ("Overstay"), you no longer have a license to stay in the Accommodation and the Host is entitled to make you leave. In addition, you agree to pay, if requested by the Host, for each 24-hour period (or any portion thereof) that you Overstay, an additional fee of up to two times the average daily Listing Price plus all applicable Service Fees and Taxes.
Property Damage: As a Guest, you are responsible for leaving the Accommodation in the condition it was in when you arrived. You are responsible for your own acts and omissions and are also responsible for the acts and omissions of any individuals whom you invite to, or otherwise provide access to, the Accommodation. You authorize Jula to charge your payment method affecting the booking for the cost of repairing any damage caused by you.
Experiences and Travel Risks: By participating in an Experience or Travel service, you acknowledge that certain activities carry inherent risks. You assume full responsibility for your participation and agree that Jula is not liable for any injury, loss, or damage resulting from your participation.
Collection and Return: Hosts may require a Security Deposit, payable either through the Platform or in cash upon check-in. Deposits are fully refundable upon check-out, provided no damage has occurred due to negligence or violation of House Rules.
Deductions and Disputes: Hosts have the right to deduct from the Security Deposit for verified damages after notifying the Guest. Hosts must provide a fair and accurate estimate for repairs or replacements. In the event of a dispute regarding damages or deposit deductions, Jula may, at its discretion, act as a mediator.
Excess Damages: If damages exceed the Security Deposit amount, the Host may seek to recover the balance through Jula's resolution center or through competent courts and arbitration.
Part 3: Terms for Hosts (Stays & Experiences)
Accuracy: You are solely responsible for setting your price and ensuring that your Listing content (photos, descriptions, amenities) is completely accurate and not misleading.
Availability: You must keep your calendar availability up-to-date at all times. Failure to honor confirmed bookings due to inaccurate availability may result in penalties or suspension from the Platform.
Compliance: You represent and warrant that you are authorized to provide the services you market on Jula.
- For Stays: You must have the right to rent the property and comply with all local zoning, safety, and rental regulations.
- For Experiences: You must hold all necessary licenses, permits, and certifications required to lead your activity in your jurisdiction.
Jula takes no responsibility for your failure to comply with local laws or acquire necessary permits.
Payout Timing and Method: Jula transfers payouts to the bank account specified by you in your account settings (which must match your provided bank statement). The timing of the payout release depends on the cancellation policy applicable to the booking. Funds are generally transferred either (a) 1-2 working days after Jula receives the funds from the Guest, or (b) released after the Guest's scheduled check-in. Jula is committed to processing all fund transfers in a timely fashion that protects the rights and security of all parties involved.
Fees: Jula charges agreed-upon Service Fees for the use of the platform, which will be deducted from your Payout.
Taxes: You are responsible for understanding and complying with any laws, rules, or regulations concerning your Listing and Host Services. You are solely responsible for determining your obligations to report, collect, remit, or include in your Listing prices any applicable VAT, Municipality Fees, sales tax, or income tax ("Taxes"). Unless separately agreed, Jula is not responsible for the collection and remittance of such Taxes to the relevant authorities.
Jula provides a marketing platform only. No joint venture, partnership, employment, or agency relationship exists between you and Jula as a result of this agreement or your use of the Platform. You act exclusively on your own behalf and for your own benefit, and not on behalf, or for the benefit, of Jula.
Part 4: Legal Provisions
"As Is" Basis: The Platform is provided "as is". Jula disclaims all warranties, express or implied.
Limitation of Liability: To the maximum extent permitted by law, Jula shall not be liable for any incidental, special, exemplary, or consequential damages, including lost profits, loss of data, or goodwill, or the cost of substitute products or services, nor for any damages for personal or bodily injury or emotional distress arising out of or in connection with these Terms, or from the use of or inability to use the Platform.
You agree to release, defend, indemnify, and hold Jula and its affiliates and subsidiaries harmless from and against any claims, liabilities, damages, losses, and expenses, arising out of or in any way connected with your breach of these Terms or your interactions with any Member.
Amicable Resolution: You agree to first contact Jula support and attempt to resolve any dispute informally for at least 30 days before initiating any legal proceeding.
Mediation: In disputes between Guest and Host, Jula may, at its sole discretion, choose to act as a mediator but is under no obligation to do so. Decisions made by Jula in its capacity as a mediator are final binding for the purpose of platform usage, though this does not waive your right to pursue legal action in competent courts.
These Terms will be interpreted in accordance with the laws of the jurisdiction in which Jula is registered, without regard to conflict-of-law provisions. Judicial proceedings must be brought in the competent courts of such jurisdiction, unless we both agree to some other location.
Jula reserves the right to modify these Terms at any time in accordance with this provision. If we make changes to these Terms, we will post the revised Terms on the Platform and update the "Last updated" date at the top of these Terms. For material changes, we may provide you availability notice via email or in-app notification. Your continued use of the Platform will constitute acceptance of the revised Terms.
- Severability: If any provision of these Terms is held to be invalid or unenforceable, such provision will be struck and the remaining provisions will be enforced.
- No Waiver: Jula's failure to enforce any right or provision in these Terms will not constitute a waiver of such right or provision unless acknowledged and agreed to by us in writing.
- Assignment: You may not assign or transfer these Terms or your rights without Jula's prior written consent. Jula may assign these Terms without restriction.
- Force Majeure: Jula shall not be liable for any delay or failure to perform resulting from causes outside its reasonable control, including, but not limited to, acts of God, war, terrorism, riots, embargos, acts of civil or military authorities, fire, floods, accidents, strikes or shortages of transportation, facilities, fuel, energy, labor or materials.
- Entire Agreement: These Terms, together with the Privacy Policy and any other policies applicable to your use of the Platform, constitute the entire and exclusive understanding and agreement between Jula and you regarding the Platform.
